====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-11-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in case registered for the offence punishable under Section 379 of the Indian Penal Code.

3. Informant alleged that on 20.11.2023 the F.I.R. named accused person along with some unknown miscreants committed theft of equipments in his saw mill with the help of five tractors and JCB.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. No stolen article has been recovered from conscious possession of the petitioner. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed

Patna High Court CR. MISC. No.72801 of 2025(2) dt.01-11-2025 2/2 the bail application and submitted that during course of investigation, stolen articles such as saw mill equipments, vehicle scrap, etc. were recovered from the scrap shop of this petitioner.

6. Considering the fact that stolen articles have been recovered from the scrap shop of this petitioner, prayer for anticipatory bail of the petitioner is refused. (Prabhat Kumar Singh, J) Navya/- U T
