ANJANA MISHRA ORAL ORDER 26-11-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor on behalf of the State. The petitioners are in custody since 03.08.2019, in connection with NTPC Khaira P.S. Case No. 47 of 2019 for the offenses under Sections 30 (a) of the Bihar Prohibition & Excise (Amendment) Act, 2018.

Learned counsel for the petitioners submits that the alleged recovery was not made from the conscious possession of the petitioners but from the Maruti Car. The petitioners are not owners of the vehicle. It is further submitted that the petitioners have got a clean antecedent.

Considering the aforementioned facts and

No.67171 of 2019(3) dt.26-11-2019 2/2 circumstances and that the petitioners have no criminal antecedent, let the petitioners, above named, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VI cum Special Judge, Excise, Aurangabad, in connection with NTPC Khaira P.S. Case No. 47 of 2019.
