JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.
Petitioner is not named in the first information report and from perusal of impugned order, it appears that the petitioner was arrested in Dinara (Bhanas O.P.) P.S. Case No. 117/2019 in which he made confessional statement before police accepting his involvement in the present case and on that basis, the petitioner was remanded in this case on 10.6.2019 but petitioner was not put on test identification parade and it appears that except confessional statement before the police that, too, in
Patna High Court CR. MISC. No.67168 of 2019(2) dt.04-11-2019 2/2 another case there appears to be nothing against the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Lal Bihari Paswan, learned Judicial Magistrate 1st Class, Bikramganj, Rohtas at Sasaram/concerned court in connection with Natwar P.S. Case No. 29/2019.
