2. The petitioners have prayed for regular bail in a case registered for the offence punishable under section 30 (a) of the Bihar Prohibition and Excise Act.

3. The case of the prosecution is that altogether 345.450 liters of country made liquor was recovered from a Tata Magic.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in connection with the present case. It is further submitted that the petitioners are driver and co-driver of the said vehicle but they

It is further contended that from perusal of the seizure list, it would transpire that all the witnesses to the seizure list are police personnel. Moreover, the petitioners are languishing in judicial custody since 25.08.2025 having no criminal antecedents.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Mirganj P.S. Case No. 151 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge (Excise -o2), Purnea.
