JUSTICE SANJAY PRIYA ORAL ORDER 09-10-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in connection with Samastipur Mahila Case no. 05 of 2017 registered under Section 376 of the Indian Penal Code, pending in the court of learned A.D.J. 1st, Samastipur.
As per written report, this petitioner took the minor daughter, aged about 12 years, of the informant near embankment and committed rape upon her. It is mentioned in the impugned order that the statement of the victim girl was recorded under Section 164 Cr.P.C. She has supported the case. There is specific allegation against the petitioner.
Considering the aforesaid facts, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly
