06-10-2018 Heard Sri Gagan Deo Yadav, learned counsel for the petitioner. None appeared on behalf of State. The sole petitioner, apprehending his arrest in Babubarhi P.S. Case No. 108 of 2018 registered for offence under Sections 272, 273, 34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. He submits that petitioner was the staff of a hotel, the owner of which was one Manoj Sah and from the said hotel, a little quantity of Indian make foreign liquor to the tune of 2.385 liter was shown to be recovered and petitioner, being staff of the hotel, has been made accused.

Considering the nature of accusation and clean antecedent, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Upendra Mahto @ Upendra Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. II (Excise Act) Special Judge, Madhubani in connection with Babubarhi P.S. Case No. 108 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
