2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 103(1) and 3(5) of the BNS.
3. As per FIR, Sonu Kumar, Dheeraj Kumar and this petitioner are alleged to have killed the husband of the informant.
4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. Informant is not an eye witness to the alleged occurrence. Petitioner claims clean antecedent and is in custody since 19.10.2024.
5. Learned A.P.P. for the State vehemently opposes
Patna High Court CR. MISC. No.72785 of 2025(3) dt.25-11-2025 2/2 the bail application and submits that there is direct and specific allegation against this petitioner that he along with Sonu Kumar and Dheeraj Kumar killed the husband of the deceased. This petitioner was seen at the place of occurrence with blood stained knife. Hence, he does not deserve regular bail.
6. Considering the nature of accusation, prayer for bail of the petitioner is rejected. However, since petitioner is in custody since 19.10.2024, Trial Court is directed to expedite and conclude the trial, preferably, within a period of one year from the date of receipt/production of copy of this order.
