Petitioner apprehends his arrest in connection with Piri Bazar P.S. Case No.69 of 2016, for the offence punishable under Sections 341, 323, 325, 337, 354, 447, 504, 506/34 of the Indian Penal Code.

The allegation against the petitioner is that petitioner assaulted the informant by means of lathi and iron rod causing her injury Learned counsel appearing for the petitioner submits that both the parties are agnates and there is land dispute between them. Learned counsel further submits that the dispute between the parties arises due to cultivation of land which was taken on lease by both the parties. Learned counsel after referring to

Patna High Court CR. MISC. No.65394 of 2019(2) dt.06-11-2019 2/2 Annexure-2 submits that injury caused to the informant on her hand has been found to be simple in nature.

Having regard to the submissions made by the parties and taking into consideration the fact that the injury has been found to be simple in nature, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is directed to surrender before the learned Court below within a period of four weeks from today and in the event of surrender by him, he shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Lakhisarai, subject to the condition as mentioned under Section 438 (2) of Cr.P.C.
