JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-10-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Motihari Town P.S. Case No. 573 of 2017 registered for the offences punishable under Sections 387 and 120-B of the Indian Penal Code.

Petitioner is not named in the first information report and his name surfaced in this case when one co-accused, namely, Atul Kashyap @ Chunnu was arrested and made his confessional statement disclosing the involvement of the petitioner in the present crime as well as in other cases.

Submission on behalf of the petitioner is that the

No.60387 of 2018 (2) dt.06-10-2018 2/2 petitioner does not have any concern with co-accused Atul Kashyap @ Chunnu and as a matter of fact, not only the present case but some other cases have also been instituted against the petitioner on the basis of so-called confessional statement of coaccused Atul Kashyap @ Chunnu. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in Motihari Town P.S. Case No. 573 of 2017 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
