08-10-2018 Heard Sri Anil Kumar Saxena, learned counsel for petitioners. None appeared on behalf of State. Six petitioners, apprehending their arrest in Amas P.S. Case No. 186 of 2018 registered for offence under Sections 272, 273, 34 of the Indian Penal Code and Section 30(a)(d) of Bihar Prohibition and Excise Act, 2016, have prayed for grant of bail in the event of their arrest or surrender. By way of referring to statement made in paragraph - 3 of the petition, learned counsel for the petitioners submits that petitioners are having clean antecedent and in the present case,

Patna High Court Cr.Misc. No.62106 of 2018(2) dt.08-10-2018 2/2 they have falsely been made accused on the basis of disclosure made by accused persons, who were apprehended by the police. Considering the fact that petitioners are having clean antecedent as well as the fact that they have been made accused on the basis of disclosure made by co-accused, there is no reason to refuse the prayer for grant of anticipatory bail. Accordingly, in the event of their arrest or surrender within a period of six weeks from today, let aforesaid six petitioners namely 1. Mahendra Singh, 2. Hiraman Kumar @ Bihara, 3. Ajay Singh Bhokata @ Ajay Singh, 4. Rama Jatan Singh, 5. Alakhdeo Singh and 6. Binod Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Gaya in connection with Amas P.S. Case No. 186 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973. (Rakesh Kumar, J.) anay U T
