1. Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 137,96,352,351(2),3(5) of the B.N.S. and Section 8 of the POCSO Act.
3. The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and petitioner
Patna High Court CR. MISC. No.73851 of 2025(2) dt.18-11-2025 2/3 nos.3 and 5 are women and the informant alleges that his daughter aged about 17 years was kidnapped by Ram Pyare Rai, Laxmi Rai and an unknown accused as disclosed by Kanchan.
4. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that victim was in love with Rampaur Rai and had eloped and has already married him. It is further submitted that petitioner nos.2, 3,4 and 5 are related to Rampaur Rai, as such, they came to be implicated. It is next submitted that the victim also filed Complaint Case No.C-1-611 of 2025 in the Court of the learned J.M.F.C., Sitamarhi against her father and others wherein her statement was taken on oath wherein she disclosed her age as 19 years and also deposed that she was in love with petitioner no.
1 and she on her own volition had accompanied him to Kolkata where they performed their marriage in a temple and they came back to Sitamarhi and started staying on rent and when the accused persons came to know that she has come back, they tried to take her back forcefully and also assaulted her husband. The learned counsel submits that the fact victim herself has instituted Complaint Case No.C-1-611 of 2025 and disclosed her age as 19 years that in itself demonstrates that the falsity of the allegation.
Patna High Court CR. MISC. No.73851 of 2025(2) dt.18-11-2025 3/3 submitted that the victim presently is staying with the petitioner no.1.
5. Learned A.P.P. opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on anticipatory bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor Court in connection with Choraut P. S. Case No.86 of 2025, subject to the conditions laid down under Section 482(2) of the B.N.S.
7. The application stands allowed.
