JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 28-11-2018 By way of the instant application preferred under Section 482 of the Code of Criminal Procedure, the petitioner has prayed for certain corrections to be made in the order dated 28.08.2018 passed in Cr. Misc. No.21353 of 2018.

2. Learned counsel for the petitioner submitted that in the sixth line on page-1 of the aforesaid order dated 28.08.2018, the date '24.04.2017' has been typed in place of '24.07.2017'. Further, in paragraph-23(a) of the order the word 'conditional' has been typed in place of 'unconditional' and in paragaph-23(c) between the words 'is' and 'remitted' the word 'not' has been left to be typed.

3. Learned counsel appearing for the State does not

Patna High Court Cr.Misc. No.60521 of 2018(4) dt.28-11-2018 2/2 dispute the aforesaid submissions made by the learned counsel for the petitioner. He conceded that there is typographical errors in the order dated 28.08.2018 passed by this Court may be correct and meaningful.

4. Having heard learned counsel for the parties, I find the prayer of the petitioner to be justified. Due to secretarial inadvertance the aforementioned typographical errors have been committee, which unfortunately could not be noticed by the Court while signing the order.

5. In that view of the matter, in the sixth line on page1 of the order dated 28.08.2018 passed in Cr. Misc. No.21353 of 2018, the date typed as '24.04.2017' be read as '24.07.2017'. Similarly, in paragraph-23(a) of the order on page 14 the word typed as 'conditional' be read as 'unconditional' and in paragraph-23(c) on page 15 in between the words 'is' and 'remitted' not should be treated to have been typed.

6. The prayer for modification of the oral judgment dated 28.08.2018 is allowed to the extent indicated above. (Ashwani Kumar Singh, J) Md. S./- U T
