2. The petitioner is apprehending his arrest in a case in connection with Narpatganj P.S. Case No. 79 of 2024 dated 10.02.2024 registered for the offences punishable under Sections 147, 149, 341, 323, 325, 302 and 201 of the Indian Penal Code.

As per the prosecution case, the informant alleged that her brothers and nephew were going to Gokhlapur Bazar and in that course seven accused persons assaulted the brother and nephew of the informant. On hulla the nearby persons came and pacified the matter, and after some time his son namely Md. Shakib went to purchase some household item there the accused

The informant alleges that for concealing the dead body of her son, the accused persons kept the dead body at the bank of canal.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has no concern with the alleged offence. The allegation is general and omnibus in nature against the named seven co-accused persons due to which the boy succumbed to death. The petitioner has got no criminal antecedent as stated at para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Araria in connection with Narpatganj P.S. Case No. 79 of 2024, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
