JUSTICE BIRENDRA KUMAR ORAL ORDER 01-10-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.

The statement of the victim girl recorded under Section 164 Cr.P.C. would reveal that the main allegation is against her tutor-Karan Kumar. However, the statement further reveals that she moved to different places including to Delhi alongwith Karan Kumar without making any protest. Petitioner has got no criminal antecedent nor he is named by the victim.

Hence, let the petitioner, above named, in the

Patna High Court Cr.Misc. No.60777 of 2018 (2) dt.01-10-2018 2/2 event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with POSCO Case No.22 of 2017, arising out of Madhepura P.S.Case No.243 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
