JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-10-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Mohammadpur P.S. Case no. 67 of 2017, registered under Sections 341, 448, 323, 324, 307, 379, 325, 504 and 506/34 of the Indian Penal Code.

The accusation is that on 17.07.2017 at about 8.00 A.M. petitioners along with Rupesh Kumar Singh and Miku Singh entered in the house of the informant and forcibly tried to take thumb impression, on blank paper, of the mother of the informant. On hearing hulla, the informant reached near his mother then saw that petitioners and four others were taking thumb impression then he made protest on which petitioner No.1 gave dagger blow caused blood oozing injury at his head. At that time, petitioner No.2 also caused injury through

Patna High Court Cr.Misc. No.47592 of 2017 (2) dt.10-10-2017 2/2 knife. At that time Rupesh Kumar Singh took thumb impression of his mother and fled away.

Learned counsel for the petitioners submits that petitioners and informant are Gotiya and due to land dispute the occurrence of Marpit took place. Moreover, the injuries as found on the person of informant and his mother are simple in nature. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in connection with Mohammadpur P.S. Case No. 67 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
