====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 20-09-2018 Heard Sri Anil Kumar Singh, learned counsel for the petitioners and Sri Satyendra Prasad , learned Additional Public Prosecutor.
Two petitioners, having clean antecedent, which fact has been stated in paragraph - 3 of the petition , apprehending their arrest in connection with Noorsarai P.S. Case No. 165 of 2018, registered for the offence under Section 30(A) of the Bihar Prohibition and Excise Act, 2016, have prayed for grant of bail in the event of their arrest or surrender. It was argued by Sri Anil Kumar Singh, learned counsel for the petitioners that nothing was recovered from conscious possession of the petitioners, rather in the case recovery of 30 liters of country made liquor was shown from a
Patna High Court Cr.Misc. No.58629 of 2018(2) dt.20-09-2018 2/2 maize field not belong to the petitioners.
Be that as it may, considering the nature of accusation and clean antecedent of the petitioners, in the event of their arrest or surrender within a period of six weeks from today, let the aforesaid two petitioners namely, (1) Mangraila Paswan; &
(2) Mantu Paswan be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of learned VIth Additional Sessions Judge - cum- Special Judge, Excise, Nalanda at Biharsharif / concerned court in connection with Noorsarai P.S. Case No. 165 of 2018 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973.
