The petitioner is in custody since 04.11.2022 in connection with Special Case No. 7318/2022 (arising out of Masaudhi P.S. Case No. 738 of 2022) registered for the offence punishable under Sections 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Considering the nature of allegation levelled against the petitioner and also the fact that he is in custody since 04.11.2022, this application is allowed.

Let the petitioners, above named, be released on bail,

No.72625 of 2022(2) dt.04-03-2023 2/2 after framing of charge on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge-Excise, Patna in connection with Special Case No. 7318/2022 (arising out of Masaudhi P.S. Case No. 738 of 2022).

The petitioner shall cooperate in the proceedings of the Court below. If the petitioner tries to delay the trial then the Court below is at liberty to pass an appropriate order including the cancellation the bail bonds of the petitioner. The petitioner shall mark his presence in Punpun Police Station, District-Patna on 1st Sunday of every month, failing which, his bail bonds shall be cancelled by the Court below.
