JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 18-10-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Wazirganj P.S. Case No. 275 of 2017 registered under Sections 341, 323, 325, 307, 354, 379, 504 and 506 read with 34 of the Indian Penal Code.

Considering the serious nature of allegation in which several persons sustained injuries and out of which, one is grievous in nature, I am not inclined to grant pre-arrest bail to

Patna High Court Cr.Misc. No.48615 of 2017 (2) dt.18-10-2017 petitioners no.1 to 3, namely, Brahmdev Prasad, Sitaram Prasad and Rajesh Prasad. Their application for grant of pre-arrest bail is rejected.

So far as the petitioner no.4, Basudeo Mahto is concerned, it has been argued that he is sufficiently aged person and three of his sons have been made accused in this case. In that view of the matter, he is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Gaya in connection with Wazirganj P.S. Case No. 275 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C. in the event of arrest or surrender in the court below within six weeks from today.
