ABHISHEK REDDY ORAL ORDER 09-02-2024 Learned counsel for the petitioner states that the petitioner has given an application to the Regional Commissioner, Tirhut Division, Muzaffarpur ventilating her grievances, taking objection to the appointment of respondent no. 7 as a P.D.S. dealer and therefore, seeks a direction from this Hon'ble Court to direct the respondent no. 2 to dispose of the said application by fixing some time frame.

2. Learned counsel appearing on behalf of the respondent stated that as per the amendment issued by

Patna High Court CWJC No.15991 of 2023(2) dt.09-02-2024 2/2 notification dated 21.07.2022 to the Bihar Authority and Public Distribution System Control, IInd Amendment Order2022, the Divisional Commissioner is a competent authority for redressal of the grievances of the petitioner and he has no objection, if a direction is given to the Divisional Commissioner to dispose of the said application made by the petitioner in accordance with law.

Having regard to the above made submissions without going into merits and demerits of the case, the present writ petition is disposed of directing the respondent no. 2 to dispose of the application made by the petitioner as expeditiously as possible preferably within a period of eight weeks from the date of receipt of the copy of this order. Any order passed shall be communicated to the parties. The Divisional Commissioner before passing any order shall put all the parties on notice and give them an opportunity of filing their objections/hearing.

4. With the above direction, the present writ application stands disposed of.
