ANJANA MISHRA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 16.08.2019 in connection with Sirdala P.S. Case No.232 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner. It is further submitted that the petitioner is not having any criminal antecedents.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand)

Patna High Court CR. MISC. No.68288 of 2019(2) dt.04-11-2019 2/2 with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-II Cum Special Judge, Excise, Nawada, in connection with Sirdala P.S. Case No.232 of 2019.
