The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 420, 465, 468, 406, 409, 201 and 120B of the Indian Penal Code. The prosecution case as per the written report of Suresh Rai dated 28.10.2016 submitted to the Station House Officer, Goraul P.S., to the effect that the petitioner got mutation done with regard to the ancestral land appertaining to Thana No. 4, Khata No. 179, Plot No. 64 situated in village - Bhikhanpura in the District of Vaishali.

It is submitted by learned counsel for the petitioner that the petitioner is the wife of own brother of the

Patna High Court Cr.Misc. No.59790 of 2018 (2) dt.28-09-2018 2/2 informant and in the background of share dispute, the accusation has been levelled. The informant has to option to challenge the order of opening of Jamabandi in favour of the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the petitioner is named in the FIR with specific accusation.

Considering the accusation arising out of civil nature of dispute and petitioner being a lady, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Goraul P.S. Case No. 255 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
