JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 14-03-2018 Heard learned counsel for the petitioner and the counsel appearing on behalf of the respondent corporation. The only objection raised on behalf of the respondents is that petitioner has not passed TET and as such he is not eligible for consideration of appointment as Municipal Teacher. Learned counsel for the petitioner, Mr. Sahi has drawn the attention of this court at Annexure-7 series which indicated that the petitioner has passed examination and qualified. The result card is enclosed as Annexure-7 series in the rejoinder to the counter affidavit.

In view of the Annexure-7 series there is absolutely no

Patna High Court CWJC No.15617 of 2017(3) dt.14-03-2018 2/2 impediment in the way of consideration of the case of the petitioner for appointment, the respondents are directed to take appropriate decision for appointment of the petitioner on compassionate ground within a maximum period of sixty days from the date of receipt/production of a copy of this order. They cannot take a plea that the petitioner lacks any eligibility for appointment as Municipal Teacher, if respondents adopts dillydally in the matter of consideration for appointment on compassionate ground, the court will take such inaction and dilly-dally seriously.
