The petitioner apprehends his arrest in connection with Rajauli P.S. Case no. 208 of 2018 registered under Sections 341, 323, 337, 338, 307, 379, 504 and 506/34 of the Indian Penal Code.
Petitioner along with three accused persons are said to have assaulted the informant by means of lathi and stone. Petitioner assaulted the informant by means of stone on his head inflicting bleeding head injury.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. Petitioner is quite innocent. Petitioner has been falsely implicated in the
Patna High Court Cr.Misc. No.63246 of 2018(2) dt.19-12-2018 2/2 case by the informant due to land dispute. Informant has not sustained any injury in the occurrence. The occurrence is said to be of 26.06.2018 but the F.I.R. has been lodged after inordinate and abnormal delay of three days on 29.06.2018 without assigning any plausible reason for the same. In the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Nawada in connection with Rajauli P.S. Case No. 208 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Prakash Chandra Jaiswal, J) mantreshwar/- U T
