Petitioners are apprehending their arrest in connection with Bagengola PS Case No. 39/2018 for the offence under Sections 147, 148, 448, 379, 354, 323,307 and 427 of the Indian Penal Code.

Learned counsel appearing for the petitioners submits that petitioners have no criminal antecedent. From the FIR it appears that 32-35 persons of Harijan Toli entered his house and committed the crime. All named accused persons have committed offence but there is no specific allegation against the petitioner and he has been falsely implicated in the case. Learned counsel further submits that similarly circumstanced co-accused namely Sanjay Ram @ Sanjay Kumar Ranjan and

Patna High Court Cr.Misc. No.62707 of 2018(2) dt.13-12-2018 2/2 others have been granted anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 53840 of 2018 vide order dated 12.09.2018.

Considering the aforesaid, in the event of arrest or surrender before the court below within a period of one month from today, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Buxar in connection with Bagengola PS Case No. 39 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
