The petitioner has prayed for bail in a case registered for the offence punishable under section 37(i) of the Bihar Prohibition and Excise Act.

The prosecution case in nutshell is that petitioner along with other six persons were arrested in drunken state. It has been reported by I.O. that the petitioner has been previously arrested for the same offence.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. It is also submitted that petitioner

Patna High Court CR. MISC. No.71249 of 2022(2) dt.06-01-2023 2/2 was not in drunken state but the police with some malafide intention had falsely implicated him in the present case. He is languishing in judicial custody since 22.09.2022. Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge V-cum-Exclusive Special Court II, Excise Act, Lakhisarai in connection with Excise P.S. Case No. 346 C2 of 2022.
