The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(a), 38(i)(ii), 39(a) and 41(i) of the Bihar Prohibition and Excise Act, 2016. Considering the criminal antecedent of the petitioner including antecedent of cases registered under the Excise Act, I am not inclined to enlarge the petitioner on anticipatory bail in connection with Dalsingsarai Police Station Case No. 213 of 2017 pending in the court of learned 3rd Additional Sessions Judge-cum-Special Judge, Excise, Samastipur.
Hence, prayer for anticipatory bail is refused. However, prayer of the petitioner for regular bail shall be considered by the learned court below without being prejudiced by this order.
