Heard learned senior counsel for the petitioners, Sri N.K. Agarwal and learned A.P.P. for the State, Sri Chandra Bhushan Prasad.

Learned senior counsel for the petitioners, after arguing vehemently for some time realising his difficulty, seeks permission to withdraw the anticipatory bail application with respect to petitioner No. 2, Najim @ Md. Nazim Iqubal @ Nazim. 3.

Permission is accorded.

Accordingly, the anticipatory bail application is dismissed as withdrawn with respect to petitioner No. 2, Najim @ Md. Nazim Iqubal @ Nazim.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 115(2), 126(2), 118(1), 117(2), 109, 76, 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that his son, Md. Sajjad, was intercepted by the accused persons on 4-8-2025 at 10:30 am, when he was going to Amoura; and on order of Mamnoon Hussain, accused Tauquir assaulted Sajjad by an iron rod causing injury on head, thereafter Najim assaulted Azad by daab causing injury on head, thereafter all the accused persons assaulted his son and other family members who came to rescue them, further Tauquir tore the clothes of his daughter-in-law, further Shadab assaulted the informant by an iron rod causing injury on head, when he tried to save his daughter-in-law.

Learned senior counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that there is a long standing land dispute in between the parties; and from the side of the petitioners Amour PS case No. 339 of 2025 has been instituted. It is also submitted that injury suffered by Sajjad and

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned senior counsel for the petitioners, the petitioner Nos 1 and 3, above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Amaur P.S. Case No. 338 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS.
