ANJANA MISHRA ORAL ORDER 19-11-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 18.08.2019 in connection with Basantpur (Lakdi Naviganj O.P.) P.S. Case No.300 of 2019 registered for the offence under Sections 379 and 411 of the Indian Penal Code.

Learned counsel for the petitioners submits that only because there has been verbal duel between the petitioners and the informant, that the theft of the mobile has been saddled on the shoulders of the petitioners. It is further submitted that though the allegation is that the petitioners were chased and the mobile was recovered from their

No.70686 of 2019(3) dt.19-11-2019 2/2 possession, the said story is wholly improbable and it is on pure suspicion that since the informant had gone to purchase medicine along with his sister in the market area, the petitioners were apprehended and the allegation of snatching of mobile from the sister of the informant is also far-fetched. It is further submitted that the petitioners shall co-operate in any other further investigation and also during the course of the trial.

Considering the aforementioned facts and circumstances and that the petitioners are not having any criminal antecedents, let the petitioners, above named, be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan, in connection with Basantpur (Lakdi Naviganj O.P.) P.S. Case No.300 of 2019.
