The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Section 376 of the Indian Penal Code.

Allegation against the petitioner is that on the pretext of marriage, he ravished the informant/victim and also recorded her obscene videos.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in

It is further submitted that medical report does not corroborate with the prosecution version of the case. Moreover, the petitioner is in judicial custody since 21.06.2023.

Learned APP appearing on behalf of the State vehemently opposed the prayer of the petitioner and submitted that the victim has supported the prosecution case and whispered about the complicity of petitioner in commission of her rape, in her statement recorded under Section 164 of Cr.P.C. She has specifically stated that petitioner has committed rape with her on the pretext of solemnization of marriage and recorded her obscene video. It is further submitted that petitioner has made her objectionable video viral.

Having heard the learned counsel for the parties and considering the nature of allegation, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected.
