2. The petitioner has earlier moved before this Court with a prayer for anticipatory bail which was rejected vide order dated 20.09.2024 passed in Cr. Misc. No. 69103 of 2024.

3. The petitioner seeks bail in connection with S. Tr. No. 309 of 2025, arising out of Saharsa Sadar P.S. Case No. 72 of 2024, registered under Sections 341, 323, 326, 307, 379, 384, 386, 504, 506 and 34 of the Indian Penal Code.

4. The prosecution case, in short, is that, on the alleged date of occurrence the petitioner along with other co-accused persons demanded ransom of Rs. 5,00,000/- and on nonfulfillment of their demand they started assaulting the informant

5. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Learned counsel for the petitioner further submits that there is no specific overt act alleged against the petitioner. From perusal of the FIR, it would reveal that petitioner was holding sword in his hand and all other co-accused persons, including the petitioner has assaulted the informant and his friend. The petitioner has got no criminal antecedent and he is in custody since 22.04.2025. Learned counsel for the petitioner further submits that similarly situated co-accused have been granted bail by this Court vide order dated 27.06.2025 passed in Cr. Misc. No. 40033 of 2025.

6. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner, stating that the offence alleged is serious in nature.

7. Considering the aforesaid facts and circumstances of the case, taking into account the period of custody undergone by the petitioner and claim based on parity, this Court is inclined to grant bail to the petitioner.

8. Let the petitioner be released on bail on furnishing bail
