Petitioner apprehends arrest in K Hat (Madhubani) Police Station Case No 167 of 2018 registered under Sections 380/34, 504, 506 of Indian Penal Code.
Learned counsel for the petitioner submits that the allegation made in the first information report in respect of the petitioner is false. There is nothing on record to suggest that he was facilitating disposal of the stolen articles by the other accused persons. Petitioner has not been apprehended at the scene of the crime like other accused persons. There is also a counter case lodged by the petitioner alleging that the informant has trespassed in his house and assaulted him along with his
Patna High Court Cr.Misc. No.65615 of 2018(2) dt.13-12-2018 2/2 parents. The petitioner has no criminal antecedent prior to the instant case.
Considering the aforesaid circumstances, prayer for anticipatory bail is allowed. In the event of his arrest or surrender before the Court within four weeks from today, the petitioner above named shall be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in K Hat (Madhubani) Police Station Case No 167 of 2018 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
