Without going into merits of the case, having regard to the fact that the matter is still pending before the SubDivisional Certificate Officer, Bikramganj, Rohtas, i.e. respondent No. 3, the present writ petition is disposed off with a direction to the petitioner to file its objections under Section 9 of Bihar & Orissa Public Demands Recovery Act, 1914 within a period of ten days from today. And on such objections is being filed, the authority concerned shall pass necessary orders strictly in accordance with law under Section 10 of Bihar & Orissa Public Demands Recovery Act, 1914. The entire exercise shall
Patna High Court CWJC No.16006 of 2023(2) dt.05-02-2024 2/2 be completed within a period of four weeks from the date of receipt of objections by the respondent No. 3. It is made clear that in case the petitioner does not file the objections under Section 9 of Bihar & Orissa Public Demands Recovery Act, 1914, within a time stipulated by this Court, the respondent No. 3 is free to take necessary action in accordance with law. Till such time the final orders are passed, the authorities concerned are directed not to take any coercive steps against the petitioner.
3. With the above direction, the present writ petition stands disposed off.
