The petitioner seeks bail in connection with Saraiya P.S. Case No. 258 of 2002, registered for offence punishable under Section 392 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Further submission is that the alleged motorcycle has not been recovered from the possession of the petitioner. The petitioner is in custody since 19.06.2019. Learned A.P.P. appearing for the State opposes the prayer for bail of the petitioner and submits that there is specific allegation against the petitioner.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.64798 of 2019(4) dt.18-12-2019 2/2 and the submissions advanced on behalf of the parties, I am not inclined to grant bail to the petitioner.

Accordingly, this application is rejected with liberty to the petitioner that he may renew his prayer for bail after framing of charge.
