The petitioner seeks regular bail in connection with Maner P.S. Case No. 382 of 2017 for the offences punishable under Sections 379, 411/34 of the Indian Penal Code and section 7 of the Essential Commodities Act.
The allegation against the petitioner is dealing with the subsidized rice and the same was confiscated from a pick-up van upon being intercepted by the police officials. Upon interrogation, it was disclosed that the said rice was being carried for black marketing and thereafter the petitioner is said to have been arrested.
Learned counsel for the petitioner submits that vague allegation is there against the petitioner and the said rice in fact
Patna High Court Cr.Misc. No.49703 of 2017 (2) dt.17-10-2017 2/2 was not confiscated from his godown or his shop, hence he does not have any complicity in the case. However, he submits that he is ready to deposit a sum of Rs. 35,000/- before the learned trial court subject to result of the case.
For the reasons stated hereinabove, I deem it fit and appropriate that the petitioner may deposit a sum of Rs. 35,000/- within two weeks before the trial court and immediately upon depositing the aforesaid amount, the learned trial court shall enlarge the petitioner on regular bail on such condition(s) as it may deem fit and appropriate.
The petition is disposed off.
