The petitioner seeks bail in connection with Korha P.S. Case No.265 of 2023 registered for the offence under Sections 302/34 of the Indian Penal Code.

The allegation against the petitioner is to have committed murder of son of the informant along with other co-accused person.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case, where, name of the petitioner surfaced on the basis of suspicion and petitioner is a lady, who is wife of the deceased. It is submitted that specific allegation is

Patna High Court CR. MISC. No.74865 of 2023(3) dt.21-02-2024 2/2 not against this petitioner and the allegation is general and omnibus in nature. It is further submitted that the petitioner is a man of clean antecedent and he is in custody since 30.05.2023. 5.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner and submitted that it appears from the impugned order that cause of death of the deceased is Asphyxia as a result of hanging.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with Korha P.S. Case No.265 of 2023 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar.
