2. The petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366(A) and 120B of the Indian Penal Code.
3. The case of the prosecution, in short, is that the petitioner has kidnapped the minor daughter of the informant.
4. Learned counsel for the petitioner has submitted that during course of investigation, the victim was recovered and her statement was recorded under Section 180 of the B.N.S.S. The learned Trial Court has recorded in its order that the victim had love affair with the petitioner so she went away with the petitioner and solemnized marriage on her sweet will
Patna High Court CR. MISC. No.71854 of 2025(2) dt.13-10-2025 2/2 and after their conjugal life, the victim gave birth to a male child.
5. Learned counsel for the informant is present and he has also conceded to the argument that the marriage has been solemnized and the victim has given birth to a male child.
6. Considering the facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court of POCSO-cum-VIIth Additional Sessions Judge, Bhagalpur in connection with POCSO Case No.182 of 2025, arising out of Bhawanipur P.S. Case No.82 of 2024.
