JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-05-2024 The present writ petition has been filed seeking the following relief:- "1. That this is an application praying for issuance of writ/ writs Certiorari of appropriate in nature for directing and commanding to the respondents for remove the encroachment from the village way bearing Khata No. 124, Plot No. 264 which has been illegally encroached by the private respondents no.7 and 8 to filled up soil (Mitti) at high level, constructed nad for feed animals

Patna High Court CWJC No.16685 of 2023(2) dt.14-05-2024 2/2 also have constructed drainage in middle of the way and constructed Pakka Chabutra on way and have closed the way of communication of the villagers when ever this land is gair mazarua land and an application filed by the petitioner before the state respondents praying for remove the encroachment from way but no action has been taken by the respondents and till the date no encroachment has been removed from the way and the entire villagers including the petitioners are facing trouble treble due to illegal encroachment by the private respondents."

After some arguments, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Sonbhadra, Bansi Surypur, for redressal of his aforesaid grievances. Liberty, so sought, is granted.

Accordingly, the present writ petition stands disposed off.
