JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-10-2019 This is an application for grant of anticipatory bail in connection with Jandaha P. S. Case No. 183 of 2018, disclosing offences under Sections 448, 323, 324, 307, 379, 504, 506, 354, 34 of IPC.
As per F.I.R. the informant has a land dispute between Pradeep Rai and Ravinder Rai and all the accused persons including the petitioners have abused and assaulted the informant, causing injury and specific allegation against Ravinder Rai of assault by Gandasa.
Submission of the learned counsel for the petitioners is that no specific allegation has been attributed against them
Patna High Court CR. MISC. No.65721 of 2019(2) dt.21-10-2019 2/2 and they are not even the family members of Pradeep Rai and Ravinder Rai.
Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate-XI, Vaishali at Hajipur, in connection with Jandaha P. S. Case No. 183 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
