JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-03-2023 After some argument, learned counsel for the petitioners seeks permission to withdraw this anticipatory bail petition in respect of petitioner no. 1 (Mukesh Kumar). Permission is accorded. This anticipatory bail petition stands dismissed as withdrawn so far as petitioner no. 1 Mukesh Kumar is concerned.

The petitioners (i.e. petitioner no. 2, 3 & 4) apprehend their arrest in a case registered for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 302, 379, 504 of the Indian Penal Code.

No.71364 of 2022(2) dt.23-03-2023 2/2 As per F.I.R., petitioner no. 2 & 3 are alleged to have assaulted the informant with rod and snatched gold chain from her neck, whereas petitioner no. 4 is only alleged to have snatched gold chain from the neck of informant's husband. Petitioners are female and carry general and omnibus allegation. It is further submitted that the allegation of snatching gold chain is ornamental only with a view to make the offence grave. Petitioners claim clean antecedent.

Considering the aforesaid facts and circumstances, let the petitioners i.e. petitioner no. 2, 3 & 4, as named above, in the event of their arrest/surrender within a period of six weeks from today, are directed to be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Muzaffarpur in connection with Baruraj P.S. Case No. 192 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. This application is, accordingly, disposed of. (Prabhat Kumar Singh, J) anay/- U T
