2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 319(2), 318(4), 338, 336(3), 340(2) and 3(5) of the B.N.S..
3. As per prosecution case, it is alleged that this petitioner, along with one Indradeo Mistry, fraudulently purchased certain lands from one Phul Kumari Devi which belonged to the informant.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is bona fide purchaser of the land in question and has purchased the same from Phul Kumari Devi after payment of full consideration money. The land in
Patna High Court CR. MISC. No.71824 of 2025(2) dt.14-10-2025 2/3 question belongs to Phul Kumari Devi and she sold the land to one Ansar Mial vide sale deed dated 28.11.2024. Moreover, the dispute is with regard to sale and purchase of land which is purely civil in nature and none of the acts allegedly committed by this petitioner would give rise to any criminal liability. Similarly situated co-accused, namely Kundan Kumar, has already been granted the privilege of anticipatory bail by this Hon'ble Court vide order dated 08.10.2025 passed in Cr. Misc. No. 70449 of 2025. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case, nature of accusation, claim based on parity and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Sherghati, Gaya Jee in connection with Imamganj P.S. Case No.
