JUSTICE ALOK KUMAR PANDEY ORAL JUDGMENT Date : 12-11-2024 In the instant petition, petitioner has prayed for the following relief(s):- "That this application is being filed for issuance of an appropriate writ/writs and order/orders in the nature of certiorari for quashing the order dated 24.02.2014 passed by Respondent No.3, the Sub-divisional Officer, Simri Bakhtiyarpur by which order the Respondent No.3, Sub-divisional Officer, Simri Bakhtiyarpur has wrongly settled the Khatiyani land of the petitioner in favour of the Private Respondent No.

6 to 19, without considering the fact that petitioner has purchase the said land from Khatiyani Raiyat namely Krishna Mohan Prasad S/o Late Dineshwar Prasad and Kameshwar Prasad S/o Late Jageshwar Prasad and Deepak Kumar & Rupak Kumar S/o Amaleshwar Prasad, R/o Lalpur Tola Pirnagar, Anchal- Salkhua, District- Saharsa and land in question bearing old Khata No.48, Plot No.528, New Khata No.154, Plot No.

3/4 was on peaceful possession over the land. Further for directing and commanding the Respondent No.2 i.e.

Collector/District Magistrate, Saharsa to dispose of appeal bearing Appeal No. 2/2014 which is pending since last 10 years and till today no order has been paused related to the said matter.

And further for any other relief or reliefs for which the petitioner is found entitled in the facts and circumstances of this case."

Learned counsel for the petitioner has limited grievance that Appeal No. 2/2014 is pending before the Collector/District Magistrate, Saharsa since 2014 and despite being so many years has been lapsed, the concerned authority has not taken any step to dispose of the appeal and petitioner has suffered not only economic loss but his right of speedy hearing has also been suffered.

3. Learned counsel for the State assures this Court that the concerned authority will look into the matter.

4. In the light of the aforesaid circumstances, the present writ petition stands disposed of with direction to the Collector/District Magistrate, Saharsa to dispose of the Appeal No. 02/2014 within six months from the date of receipt of this order after hearing the parties concerned by
