2. The petitioner has prayed for bail in connection with Piro P.S. Case No. 63 of 2024 registered for the offence punishable under Section 392 of the Indian Penal Code.
3. The case of the prosecution is that the informant has withdrawn Rs. 1,20,000/- from P.N.B. CSP Centre. As he reached on his Centre at Laharabad, three persons who have covered their face pointed gun on him and took away his bag containing cash, laptop, charger etc.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. From perusal of the F.I.R. itself it is clear that F.I.R. was
Patna High Court CR. MISC. No.76240 of 2024(3) dt.22-01-2025 2/2 lodged against unknown miscreants. During couse of the investigation, the petitioner was apprehended and he has given his confessional statement. There is nothing except confessional statement of the petitoner on the record. Nothing has been recovered from his possession. He is having criminal antecedent of five cases due to which he has been named in this case. He is languishing in judicial custody since 01.05.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur in connection with Piro P.S.
