This is an application for bail in connection with Mahila P.S.Case No. 89 of 2016 registered for the offences punishable under Sections 493 and 420 of the Indian Penal Code. Allegation against the petitioner as per FIR is that he made physical relationship with the informant and taken away of her property, ATM card, passport, etc. and thereby refused to marry her.

Submission of learned counsel for the petitioner is that earlier she has lodged a case against the petitioner to create pressure upon him to marry her and further dispute has been settled between the parties and he is in custody since 14.9.2017. Heard learned APP also, who has opposed the prayer for

Having heard both sides and considering the facts and circumstances of the case, this application is disposed of with a direction to learned trial court to call the informant and if it is found that dispute between the parties is settled, the trial court will release the petitioner on bail to its own satisfaction.
