The petitioner is apprehending his arrest in a case registered under Sections 143, 144, 145, 147, 148, 149, 151, 152, 153, 153(A), 153(B), 290, 291, 295, 295(A), 298, 341, 342, 324, 326, 307, 332, 333, 337, 338, 353, 427, 504, 120(B) of the Indian Penal Code.
The prosecution case, in short, is that on account of tension arose between two community, the accused persons got infuriated and started damaging the property and created obstruction in discharge of duty by the police. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no
Patna High Court Cr.Misc. No.67205 of 2018(2) dt.22-11-2018 2/2 allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. Altogether 75 persons are named in the F.I.R. along with 500-600 unknown persons. A protest was being made against the police officers as a death of a muslim lady had taken place. The other co-accuseds were granted anticipatory bail vide order dated 20.11.2018 passed in Cr. Misc. No. 61471/2018.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Mohiuddin Nagar P.S. Case No. 96 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) Pankaj/- U T
