Prayer is for grant of bail in a case registered under Sections 399/402 of the IPC and Sections 25(1-b)a, 26/35 of the Arms Act.

Petitioner was apprehended with one country made pistol and live cartridges. It is stated that he has no criminal antecedent. He is lodged in custody since 23.08.2017. Some other co-accuseds have been granted privilege of bail. Learned APP opposed the prayer.

Considering the facts and circumstances of the case it is directed that on completion of five months of custody, if the bail bonds in the sum of Rs. 10,000/- (ten thousand) is filed in

Patna High Court Cr.Misc. No.50872 of 2017(2) dt.09-11-2017 2/2 connection with Pirbahore P.S. Case No. 445 of 2017 in the learned Court below, the same shall be accepted and the petitioner shall be released on bail subject to the condition that one of the bailors shall be own close family member of the petitioner.

The bail application is disposed of with the aforesaid observation.
