====================================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 11-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for regular bail arises out of Kishanganj P.S. Case No. 369 of 2019 (Special Case No. 23/2019), disclosing the offences under Sections 22, 27 and 29 of the N.D.P.S. Act.

It is alleged in the First Information Report that when the Police were on patrolling duty, two boys were noticed fleeing away, on seeing the police party. They were chased and apprehended. One of them was this petitioner. On search from the pocket of another person namely, Raj Alam, certain quantity of smack was recovered. From the petitioner's possession, an amount of Rs.1700/- was recovered.

Patna High Court CR. MISC. No.67610 of 2019(2) dt.11-12-2019 2/2 Learned counsel appearing on behalf of the petitioner has submitted that co-accused Raj Alam has been allowed regular bail by this Court by an order dated 14.11.2019 passed in Cr. Misc. 65800 of 2019.

Considering the above circumstance, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand), with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge, N.D.P.S. Act, Kishanganj, in connection with Kishanganj P.S. Case No. 369 of 2019 (Special Case No. 23/2019), subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail Bonds shall be liable to be cancelled.
