The petitioner is in custody since 03.09.2017 in connection with Kadamkuan P.S. Case No. 363 of 2017 registered for the offence under Sections 461, 379, 411/34 of the Indian Penal Code.

Allegation against the petitioner is that a stolen mobile was recovered from his possession. Learned counsel for the petitioner submits that the petitioner was taken into custody on the basis of the confessional statement made by one co-accused Abhishek Anand, who has categorically stated that he had sold one mobile to the petitioner after accepting an amount of Rs. 5,000/- from the petitioner. Thus, admittedly, even as per the confessional statement, the petitioner has no role to play

Patna High Court Cr.Misc. No.51917 of 2017 (2) dt.09-11-2017 in the theft of the mobile in question. It is further submitted that while purchasing the mobile petitioner had no inkling that the mobile purchased by him was in fact a stolen property.

Considering the aforesaid facts and circumstances of the case and that the petitioner has clean antecedent, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub- Judge- VII, Patna in connection with Kadamkuan P.S. Case No. 363 of 2017.
