The petitioner, being the father-in-law of the victim, is apprehending his arrest in a case registered for the offence punishable under Sections 304B/34 of the Indian Penal Code. The prosecution case is of killing the sister of the informant within one year of the marriage for non-fulfillment of further dowry demand of a motorcycle.
It is submitted by learned counsel for the petitioner that the thrust of accusation is against the husband of the victim and considering the omnibus and general accusation other inlaw family members have been granted anticipatory bail by a coordinate Bench of this Court vide Cr. Misc. No. 57825 of
Patna High Court Cr.Misc. No.65083 of 2018(2) dt.12-12-2018 2/2 2017.
Learned APP submits that the petitioner is also named in the FIR.
Considering the thrust of accusation against the husband of the victim and the fact that other in-law family members have been granted anticipatory bail by a co-ordinate Bench of this Court, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-4th, Samastipur in connection with Mohiuddin Nagar P.S. Case No. 07 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
