2. The petitioner is apprehending arrest in connection with Sirdala P.S. Case No. 266/2023 instituted under Sections 341, 323, 324, 325, 307, 379, 504, 506/34 of the Indian Penal Code lodged on 1.7.2023 by the informant, Birendra Prasad Kumar.

3. As per the prosecution story, the informant alleged that while he had gone to the house of Gopal Prasad for demanding wages, the same was refused, abused and later, assault.

4. The allegation against this petitioner is of using iron rod causing fracture in his hand. According, the FIR.

5. Learned counsel for the petitioner submits the assault is on non vital part and he do not have criminal

6. Learned APP on the other hand points out that the injury report is part of the case diary and shows that the same is found to be grievous in nature inasmuch as fracture has been detected.

7. In that background, the anticipatory bail stands rejected.
