Mr. Sri Nand Kumar ====================================================== CORAM: HONOURABLE MR JUSTICE MADHURESH PRASAD ORAL ORDER 13-12-2018 Heard learned counsel for the petitioners and the learned APP for the State.

Petitioners apprehend arrest in Mehasi Police Station Case No 200 of 2017 registered under Sections 341, 323, 324, 307, 447, 379, 504, 506 of Indian Penal Code. Learned counsel for the petitioners submits that the occurrence is nothing but an altercation between the parties for which case and counter case have been lodged. The petitioners were on police bail and only after submission of charge sheet and taking cognizance, they have the apprehension of arrest. It is further submitted that all the offences, except Section 354 of Indian Penal Code, which also is not made out, are bailable.

No.65635 of 2018(2) dt.13-12-2018 2/2 Considering the aforesaid submissions and the fact that the petitioners have no criminal antecedent, prayer for anticipatory bail is allowed. In the event of their arrest or surrender before the Court below within four weeks from today, the petitioners above named shall be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VI, East Champaran at Motihari in Mehasi Police Station Case No 200 of 2017 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
